LUCKNOW: High court has imposed cost of Rs 5 lakh on an orphanage for giving a child in adoption illegally to a couple from Jaipur. It also directed the state to set up a probe against other officials whose inaction and conduct caused immense pain and agony to the biological mother who has been waiting for her baby boy Shiva for the last twenty months. The court further directed the adoptive parents and officials concerned to produce the child before chief judicial magistrate Barabanki on January 15. It directed the CJM to hand over the baby to his mother Nisha.

The court directed the state to provide adequate infrastructure to child welfare committees in UP to help them function better. The court has summoned action taken report on March 12.

Nisha, a native of Nau ka Purwa villege under Asandra police station in Barabanki gave birth to the boy on May 20,2012. She fell unconscious and nobody was there to attend to her. A mentally retarded woman took away the newborn baby. Villagers intervened and handed over the baby to the family. But matter reached police and Shri Ram Audyogic Orphanage Aliganj in Lucknow. Superintendent of the orphanage Ruchi Tripathi took the baby and later gave him to a couple in adoption on October 21,2012.

The mother and her family ran from pillar to post but to no avail. Then she filed a petition in the HC seeking custody of the baby. On the direction of the court DNA test was conducted which conformed the baby was of Nisha.

Justice V C Gupta found attitude of the authorities lackadaisical because of which the mother suffered. The court also imposed fine of Rs 25,400 on the superintendent.
